Wikinews interviews former Salt Lake City mayor and 2012 presidential candidate Rocky Anderson

Former Salt Lake City mayor and human rights activist Rocky Anderson took some time to discuss his 2012 U.S. presidential campaign and the newly-created Justice Party with Wikinews reporter William S. Saturn.

Anderson served as mayor of Salt Lake City for eight years (2000–2008) as a member of the Democratic Party. During his tenure, he enacted proposals to reduce the city’s carbon emissions, reformed its criminal justice system, and positioned it as a leading sanctuary for refugees. After leaving office, Anderson grew critical of the Democratic Party’s failure to push for impeachment against President George W. Bush, and for not reversing policies on torture, taxes, and defense spending. He left the party earlier this year and announced that he would form a Third party.

Anderson officially established the Justice Party last week during a press conference in Washington D.C.. He proclaimed “We the people are powerful enough to end the perverse government-to-the-highest-bidder system sustained by the two dominant parties…We are here today for the sake of justice — social justice, environmental justice and economic justice.” The party promotes campaign finance reform and is attempting to appeal to the Occupy Wall Street movement. It is currently working on ballot access efforts, and will hold a Founding Convention in February 2012 in Salt Lake City.

Among other issues, Anderson discussed climate change, health care, education, and civil liberties. He detailed his successes as mayor of Salt Lake City, stressed the importance of executive experience, and expressed his views on President Barack Obama and some of the Republican Party presidential candidates. He spoke in depth about former Massachusetts governor Mitt Romney, with whom he worked during the 2002 Winter Olympics, and fellow Utahan, former governor and U.S. ambassador to China Jon Huntsman, Jr..

Bush nominates Chertoff for new Secretary of Homeland Security

U.S. President George W. Bush nominated Federal Judge Michael Chertoff as the next Secretary of Homeland Security, replacing Secretary Tom Ridge who plans to step down Feb. 1.

Judge Chertoff has been approved by the Senate on three previous occasions and is currently a U.S. Appeals Court judge in Philadelphia. He is considered a “safe” candidate, likely to pass Senate scrutiny, a key characteristic after the White House‘s previous candidate, former New York Police Commissioner Bernard Kerik, withdrew after personal information was made public.

At the time of the September 11 attacks, Judge Chertoff was in the Justice Department and became involved as one of the architects of the Patriot act.

If confirmed Chertoff vowed his primary focus as Secretary to be, “promoting our homeland security and, as important, to preserving our fundamental liberties.”

Weve all heard the statistics; more accidents happen in the home than outside it, and one of the most dangerous places for children is the kitchen! All those hot surfaces, boiling liquids, and sometimes even dangerous chemicals make for a highly risky area for kids. But if youre spending time in the kitchen yourself, when your kids are at home, theyre going to be in and out an awful lot of the time. So how can you make it safe for them (and, incidentally, for you!)?

When the kids are tiny, most parents do the rounds of the home with an arsenal of table tennis ball type fittings to go on sharp corners, ready for when the little ones start to move about independently and those corners seem to beckon like a magnet. Well make sure rugs dont slip easily, put gates on stairways, and have beds for them with protective sides to prevent them falling out in their sleep. But the kitchen, with all its inherent dangers, is a more difficult one to protect.

Granted, most of the worktops are too high for the kids to get at easily, so sharp cutlery, glass items and other objects will be safely out of reach as long as you dont leave them too near the edges or have cloths and chopping boards overlapping the counters so that little hands can pull them down on top of themselves (I know, I have a scar on my right arm to this day from pulling at a teacloth on which a teapot was standing; I guess Im just lucky it didnt tip itself out on to my face…).

But under the counter, behind doors that are easy to open, lurks a plethora of hazardous substances. Its worth installing child-resistant locks on those lower doors; some simple and cheap ones work by only allowing the door to be opened very slowly, which an adult will do but a child wont, and these are simple for even the least expert in DIY to install. You can buy proper locks, but theres always the chance that you or someone else in the family will forget to use them, and the potential for a ghastly family row in which everyone blames everyone elsemuch better avoided, in my book. The best solution, of course, is to move all the items you do not want your child to have access to into a single cupboard, above the countertops, and fit a proper lock on it just in case!

Some of the most hazardous areas for children, though, are around cookers. If you have an oven that sits on the floor, do make absolutely sure that it cant be opened easily by prying hands and, crucially, that the front or edges of the door dont get hot enough to burn delicate skin. If necessary, change the oven to a safer one or, and this is also better for your own back when lifting heavy dishes in and out, have it moved to eye level. You cannot possibly keep an eye on your children for every second, and you simply dont want to take any chances, do you?

New Jersey to consider bikini waxing ban

New Jersey is considering a state-wide ban on Brazilian waxes, the removal of hair from the bikini area.

Although genital waxing has never really been allowed in the state, the New Jersey Board of Cosmetology and Hairstyling plans to propose a ban with more specific legal wording, in response to two women who reported being injured during a wax. The board will consider the proposal at their next meeting on April 14.

If the measure passes, New Jersey may become the only US state to ban the practice outright.

Although millions of Americans engage in bikini waxes, which generally cost between $50 and $60 per session, the practice comes with risks. Skin care experts say the hot wax can irritate delicate skin in the bikini area, and result in infections, ingrown hairs and rashes.

Waxing on the face, neck, abdomen, legs and arms would continue to be permitted in the state under the proposed ban. Although New Jersey statutes have always banned bikini waxing, the laws were unclear and seldom enforced.

As a result, many salons from around the state have offered bikini waxing for years. Many salon owners spoke out against the proposed ban, which they said would severely damage their business.

“I really don’t know if the state can stop it at this point,” said Valentia Chistova, owner of the Monmouth County salon Brazil. “I know a lot of women who are really hooked.”

Miami of Ohio and Boston College advance to 2010 NCAA men’s ice hockey Frozen Four

Obviously it was an unbelievable feeling

Miami of Ohio beat the Michigan Wolverines 3–2 at the finals of the NCAA Midwest regional ice hockey tournament Sunday night at the Allen County War Memorial Coliseum in Fort Wayne, Indiana. Miami sophomore forward Alden Hirschfeld scored at 1:54 into the second overtime when his shot from the top of the left face off circle deflected into the goal off the skate of the Michigan goaltender Shawn Hunwick.

Pat Cannone led the scoring with two power play goals for Miami during regulation. It looked as though Michigan had won the game in the first overtime when Michigan’s forward Kevin Lynch appeared to score. Unfortunately for Michigan the referee blew the whistle calling a penalty just before the puck went in the net. The Miami goaltender Connor Knapp who made 53 saves in the game was named the most outstanding player of the midwest regional tournament.

This was the first multiple overtime game for the Miami of Ohio RedHawks in their 23 years. Miami will be going to the Frozen Four for the second straight year.

It was great to see all those hats on the ice

The Boston College Eagles advanced to the Frozen Four in a shoot out with the Yale Bulldogs. BC defeated Yale 9–7 last night at the finals of the NorthEast regionals in front of 6,054 fans at the DCU Center in Worcester, Massachusetts.

BC forward Cam Atkinson had a hat trick and an assist. Mark Arcobello of Yale also had a hat trick. In an attempt to find a way to stop the Eagles scoring Yale played three different goalies during the game. The sixteen total goals is a NCAA record for a regional tournament game. The previous record was thirteen.

This will be the 22nd time that Boston College has made it to the Frozen Four, it is the ninth for coach Jerry York and their third trip in the past four seasons. BC will face Miami of Ohio in the semifinals on April 8 at Ford Field in Detroit, Michigan.

On Friday, code hosting and sharing website GitHub blocked the public access to youtube-dl, a software which can download videos from the internet via the command-line. The blockade came after GitHub received a Digital Millennium Copyright Act (DMCA) take-down notice from the Recording Industry Association of America (RIAA). After stripping the metadata from the notice, GitHub published the take-down notice on their site.

Initially started in July 2008 by Ricardo Garcia, youtube-dl is a script written in Python which can download videos from multiple websites including YouTube, LiveLeak and Vimeo. youtube-dl is a FLOSS software and is under public domain. Currently, the repository on GitHub is locked for viewers other than maintainers of the project.

RIAA’s DMCA notice alleged the script’s purpose of existence was to “circumvent the technological protection measures used by authorized streaming services such as YouTube” and “reproduce and distribute music videos and sound recordings owned by our member companies without authorization for such use”.

youtube-dl has multiple unit tests in its source code, which test whether the software works in different circumstances or not. Some of the tests include checking if the script can download Creative Commons licensed videos, videos which did not have square pixels, videos with no age restriction, “offensive to some audiences” per YouTube community and age-restricted videos. One of the tests included the URL of some copyrighted songs. Citing this test, RIAA’s take-down notice claimed “comments in the youtube-dl source code make clear that the source code was designed and is marketed for the purpose of circumventing YouTube’s technological measures”.

RIAA’s notice published by GitHub alleged violation of 17 U.S. Code § 1201 Circumvention of copyright protection systems which says “No person shall circumvent a technological measure that effectively controls access to a work protected under this title”. RIAA listed a number of forks of youtube-dl and requested GitHub via the notice they all be made inaccessible.

The notice did not list any incident of anyone using youtube-dl to download or share copyrighted material, nor mention any damages that actually occurred. Unremarked by the notice, YouTube allows videos to be licensed under a Creative Commons Attribution license. When a copyright holder chooses to release their work, be it a photograph, a video, or audio, under a Creative Commons Attribution (CC BY) license, they allow everyone to freely own, share or modify the work as long as the reusers properly attribute the author of the work. YouTube also hosts many audio and video recordings in the public domain which can be used for any purpose without any restrictions.

youtube-dl is used by thousands of people around the world. Multiple Creative Commons-licensed and public domain videos on Wikimedia Commons are uploaded via a tool called video2commons, which relies on youtube-dl to download media. youtube-dl also lets users download videos from LiveLeak — a video-sharing platform for citizen journalism. Videos downloaded using youtube-dl are also used for the purpose of fair use, or for evidence.

youtube-dl comes with a small JavaScript interpreter where it acts as a web-browser would behave while receiving video data from the server. The script has “extractors” for various websites to handle videos from different sources. Whenever something is displayed on the user’s screen, the device has a copy of that content. Web browsers “download” data while surfing the web, though most of it is not persistent on the device. It is possible to download copyrighted photos by using a web-browser. The way the world wide web works, there are no technological prevention measures to prevent recording and sharing of content such as RIAA talks about in the notice. Photos and texts can be downloaded by taking screenshots, videos by screen recording tools, and audio by recording on a tape if not an audio recording software.

Multiple users expressed their disappointment on Twitter and Internet Relay Chat. One of the users said “this is yet another example of why we should use git as it was intended, as a distributed network, rather than rely on one single proprietary server”. Git is decentralised version-tracking software which is used by a large number of software companies and projects. It is possible to host one’s own git server for software development. While Microsoft’s GitHub is a centralised git server, development of software using git does not require a GitHub account.

Soon after the public access to the repository was locked, multiple users started sharing the source code via self-hosted git servers, Tor sites and via the Torrent protocol leading to a Streisand effect. Streisand effect is when a measure to censor information causes further spread of that information. The binary files of the software are still available on its website for users to download. Some people came up with esoteric ways to share the source code, by converting the compressed code into photographs and providing shell commands to convert to the source code.

GitHub’s DMCA repository, where the takedown notice was published for public viewing, was subject to contant vandalism from multiple GitHub users. One user submitted a pull request, merging the source code of youtube-dl along with the DMCA repository. This enabled users to view youtube-dl’s source code from within the DMCA repository, provided they know the commit id.

The Electronic Frontier Foundation said on Twitter “Youtube-dl is a legitimate tool with a world of a lawful uses. Demanding its removal from Github is a disappointing and counterproductive move by the RIAA.” Richard Stallman, the founder of the Free Software Foundation, has been highly critical of DRM (digital rights management, the subject of the DMCA) for many years now.

Wikinews reached out to Sergey M?, one of the maintainers of youtube-dl script, however Sergey said he “won’t give any comments at this time”. Later, he shared an update on the IRC channel. Sergey said, “they require complete removal of so called YouTube’s rolling cipher implementation […] GitHub requires in order to reinstate the repo […] under this conditions I could reinstate it in Saturday/Sunday already but this is an unsatisfactory outcome”. He also said, “I can’t guarantee whether [or] not we will bend over them considering the situation with @phihag [Philipp Hagemeister] but we’ll see soon what we can do in order to keep the max we have and mitigate potential legal issues at the same time”.

EFF is yet to respond to Wikinews queries. Wikinews also reached out to Philipp Hagemeister, a former maintainer and contributor of the youtube-dl project to discuss this takedown.

When did you get to know about the takedown notice and what were your initial reactions?

((Philipp Hagemeister)) I saw the takedown notice along with anyone else, on reddit. Since I am no longer involved with the youtube-dl project (except for occasional contributions, my maintainership ended in 2016), I don’t know any details.

((RS)) Does YouTube implement DRM for videos not under Creative Commons license, and if so, how does youtube-dl bypass it? Could you please elaborate the procedure?

((Philipp Hagemeister)) YouTube implements DRM for YouTube Movies. youtube-dl does not support those.

YouTube has multiple non-DRM video delivery protocols. I’m not up to date about specifics; my last dabbling in this was in 2015.

One of these protocols is described here. YouTube uses JavaScript to compute parts of the URLs. youtube-dl executes this JavaScript, just like a web browser.

((WN)) Could you also explain in brief how youtube-dl functions, and how the maintainers had intended it to be used?

((Philipp Hagemeister)) youtube-dl downloads and plays videos and music, just like any other web browser, from over 1000 different services. Its uses are varied: It enables video playback on many devices (e.g. Raspberry Pi) where the video services don’t work properly, it makes high-quality video playable for people with a bad or no Internet connection, it enables disabled users to use tools to play videos, and it is used for archival and research.

((WN)) What do you think of the DMCA notice?

((Philipp Hagemeister)) I think it is not warranted because youtube-dl is entirely legal. As the DMCA notice has no effect for me personally, I’m not really the right person to address it.

((WN)) Why were the copyrighted tests in the source code? Could they be replaced?

((Philipp Hagemeister)) I’m not sure why, but my guess is that users requested support for these videos and thus they were added as test cases. They can be removed trivially, without losing any function of youtube-dl.

((WN)) Are you aware Electronic Frontier Foundation said it was a “disappointing and counterproductive move”? What do you think should be the next steps?

((Philipp Hagemeister)) Yes, and I concur. I’m no longer involved in the project. If I were, I would probably just remove the test cases, block these music videos (RIAA is not worth the trouble for me, that can be done by other projects), and get the project back online.I understand people who think differently.

To What Clauses Of Contracts Should A Freelance Translator Pay Special Attention?

Many clients will ask their freelance translators to sign contracts or work for hire agreements before beginning work. While these are often quite harmless in nature and not something to be concerned about, it’s important to read what you’re signing and to make sure that you’re not agreeing to a clause that you will later regret.

These contract clauses are mostly applicable if you work through translation agencies. For example, you should carefully consider, possibly with the advice of a lawyer, whether you will agree to terms such as:

– Agreeing not to get paid until the end client pays the agency. Of all the terms that translators are asked to accept, this is probably the most difficult. In one sense, it’s understandable that an agency doesn’t want to take the risk of having to pay tens of thousands of dollars to translators for a project that the agency itself is never paid for. In addition, if a translator returns poor quality work, the agency doesn’t want to be responsible in the event that the end client refuses to pay. On the other hand, the agency’s role as a middleman between the translator and the end client involves some financial risks, such as non-payment on the part of the end client. If you agree to this type of clause, it is important to realize that you are accepting some risk of non-payment yourself.

– Agreeing to indemnify (hold harmless) the client against lawsuits and/or claims resulting from your translation. If you sign a contract with this type of clause, make sure that you carry your own professional liability or errors and omissions (E&O) insurance in case one of your clients is sued because of an error in your translation. The client should have a quality control system in place so that an error by one translator doesn’t have a disastrous effect on the final project, but not every client will have this. This type of contract clause is more of a concern if you work for direct clients, who may be less likely to have your work edited or proofread before distributing it.

– Agreeing not to accept or solicit work from the agency’s clients. Most intermediaries between end clients and freelancers, not just translation agencies, require this type of non-compete agreement. It’s perfectly reasonable to ask that you not go behind the agency’s back and ask the end client to hire you to translate for them directly. However unless you and the agency compare your client lists (something the agency will probably be unwilling to do) you can’t really know that you’re not working for one of them.

– Agreeing not to subcontract work to another translator. This is another fairly common and reasonable clause, just make sure you read it before signing, and if you commit to doing all the work yourself, don’t share it with someone else.

– Agreeing to abide by confidentiality standards. Especially if you work in legal, financial or patent translation, you will probably come into contact with trade secrets, confidential financial information, patent applications, etc. If you sign this type of document, again it is important to read and abide by its provisions. For example, financial translators might be required to agree not to engage in insider trading as a result of their knowledge of a company’s financial information before it is released to the public. This type of document is often referred to as a non-disclosure agreement or NDA.

– Agreeing to submit to a credit check, criminal background check or financial review in order to be bonded. Like the confidentiality agreement described above, there are good reasons why some translators have to be bonded (insured against stealing because of information that they have access to).

For example if you work with a bank’s clients’ financial information, or translate information about a mutual fund’s identity verification procedures, you have access to information that would allow you to steal money from the company or its clients. In order to be bonded, most insurance or bonding companies will investigate your financial records and/or criminal background. Just make sure you are clear on what you’re agreeing to when you sign this clause, and that you understand what information about you the company is going to collect or ask for. If you have a past criminal background, make sure you understand what types of charges, arrests or convictions must be reported.

If you find a clause in a contract that you don’t want to sign, you have a few options. You could cross out the clause in question, modify it, or refuse to sign the contract completely. Whether or not this is successful depends on the client. Some agencies will agree to a change, others will refuse to work with you if you don’t sign their contract. The most important thing is to realize that if you sign a contract, its terms are legally enforceable, even if your client tells you, “I can’t imagine we would ever really enforce that…”

If the client wouldn’t enforce the clause, it shouldn’t be in their contract. Remember that although it is intimidating to be presented with a contract as a prerequisite for a certain job, you are an equal party to the contract and are entitled to object to terms that are unfair to you. Also, although contracts don’t appear to be negotiable most of the time, they often are negotiable, and in any event you are highly unlikely to lose a client simply because you have questioned one of their contract’s clauses.
